Maryland Doctor Found Liable in Wrongful Death of Maryland AttorneyThe estate of Richard H. Semsker, who passed away from brain cancer in 2007, was awarded $5.8 million dollars from a Montgomery County Circuit Court stemming from a physician’s failure to diagnose a growing mole on Mr. Semsker that developed into skin cancer, which spread to the brain. According to the state of Maryland statutory damages cap laws, the estate will only be eligible to receive $3.6 million for the medical malpractice case. Doctor Michael R. Albert, while practicing under the Dr. Normal A. Lockshin’s medical practice, failed to address irregular growth in Mr. Semsker’s back that was initially a mole in 1998. Following other routine checkups and treatments with the physicians for other ailments, the atypical mole on Semsker’s back proved still not removed in 2004, despite recommendations by doctors to do so otherwise. Additionally, the mole had doubled in size and changed color, which prompted the removal of the then cancerous mole in 2006. By this point, the skin cancer had spread throughout Semsker’s body over the course of the years. The estate of Mr. Semsker’s has also considered challenging the capping of award per Maryland state laws regarding medical malpractice cases as well.
